TERMS AND CONDITIONS (EULA) FOR SKETCHY

Please read these Terms and Conditions ("Terms", "Agreement") carefully before downloading, installing, or using the Sketchy mobile application ("App", "Service") operated by DeltaTech App Team ("we", "us", or "our").


By downloading or using the App from the Apple App Store or Google Play Store, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.

1. ELIGIBILITY & PARENTAL SUPERVISION

- Sketchy is a guided drawing and coloring application created for users of all ages, including children.

- If you are under the age of majority in your jurisdiction (typically 18 years old), you must have your parent or legal guardian's permission to use the App, make purchases, or accept these Terms.

2. LICENSE GRANT & USAGE RESTRICTIONS

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial purposes on mobile devices that you own or control, in accordance with the standard Apple App Store / Google Play Store terms of service.


You agree not to:

- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.

- Modify, translate, adapt, or create derivative works of any content, lessons, or software in the App.

- Distribute, sublicense, lease, sell, or rent the App or its lessons to any third party.

- Use the App for any unlawful, fraudulent, or harmful purpose.

3. INTELLECTUAL PROPERTY RIGHTS

- App Content & Lessons: All illustrations, lesson guides, vector paths, software, graphics, audio, user interface designs, and branding within Sketchy are the intellectual property of DeltaTech App Team and its licensors, protected by copyright and intellectual property laws.

- User Creations: You retain ownership of the original drawings, artwork, and colorings you create using Sketchy. You may export and share your personal artwork freely.

4. IN-APP PURCHASES & SUBSCRIPTIONS (SKETCHY PRO)

Sketchy offers optional premium features ("Sketchy Pro") available through in-app purchases or auto-renewing subscriptions.


A. Billing & Payment Processing:

- Payments are charged directly to your Apple ID (Apple App Store) or Google Account (Google Play Store) upon confirmation of purchase.

- Prices are displayed in your local currency in the app store before purchase and may vary by region.


B. Auto-Renewal:

- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.


C. Managing and Canceling Subscriptions:

- You can manage or cancel your subscription at any time via your device's app store account settings:

  * iOS: Settings > Apple ID > Subscriptions > Sketchy > Cancel Subscription.

  * Android: Google Play Store app > Profile Icon > Payments & Subscriptions > Subscriptions > Sketchy > Cancel.

- Cancellation takes effect at the end of the active billing cycle; no partial refunds are issued for unused periods.


D. Refunds:

- Refund requests are subject to the policies of the respective store:

  * For iOS, request refunds directly via Apple Report a Problem (https://reportaproblem.apple.com/).

  * For Android, request refunds via Google Play Store purchase history according to Google Play refund policies.

5. DEVICE HARDWARE & FEATURES (CAMERA / AR)

- The App includes camera-assisted drawing / AR tracing tools. You are responsible for ensuring that you use these features in a safe physical environment without tripping hazards or visual distractions.

- We do not capture or store camera feeds. All image processing occurs locally on your device in real-time.

6. DISCLAIMER OF WARRANTIES

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not guarantee uninterrupted, error-free, or bug-free operation.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall DeltaTech App Team, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your access to, use of, or inability to use the App.

8. APPLE & GOOGLE STORE PLATFORM SPECIFIC TERMS

This Agreement is between you and DeltaTech App Team only, not with Apple Inc. or Google LLC:

- Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App.

- In the event of any third-party claim that the App infringes intellectual property rights, DeltaTech App Team, not Apple or Google, will be solely responsible for the investigation and defense of such claim.

- Apple and Apple's subsidiaries, and Google and Google's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple and Google will have the right to enforce these Terms against you as third-party beneficiaries.

9. CHANGES TO TERMS

We reserve the right to modify or update these Terms at any time. When modifications occur, we will revise the "Last Updated" date at the top. Your continued use of the App following any changes constitutes acceptance of the new Terms.

10. GOVERNING LAW & CONTACT

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.
